This Privacy and Cookies policy ("Privacy Policy") explains the what, how and why of the information we collect when you use GCX LTD.com. It also explains the ways we use and disclose that information and the choices you have with regard to the use of your personal information (meaning any information about you which is personally identifiable, like your name, address, telephone number or email address, which will be referred to in this Privacy Policy as "personal information").

The basics

The Website is owned and operated by GCX LTD ("GCX LTD"). This Privacy Policy (together with our Terms and all other documents referred to in the Terms) applies to the use of information collected by GCX LTD, relating to you.

2. Changes

Please note that we may update and amend this Privacy Policy from time to time to reflect changes to our information practices and any changes will be posted on the Website. If you do not agree with any of the terms of this Privacy Policy, you should not use the Website and/or terminate your GCX LTD Account (as appropriate). Should you not object to the changes, we are entitled to assume that you consent to the changes to our Privacy Policy.

3. Interpretation

Unless defined in this Privacy Policy, all capitalised terms used in this Privacy Policy shall have the same meaning as given to them in the Terms.

Your information

4. Collection of information

When you open an Account with us, we collect the following personal information from you:

  • information to identify you to us and ensure that you are who you say you are. This is provided to us in accordance with our Customer Acceptance Policy and Terms;

  • contact information such as your name, Email Address, postal address and telephone number; and

  • unique identifiers such as date of birth, user name, your Password and Secret Phrase.

We may also collect and hold information relating to your directors, employees, and other individuals.

When you sign up for our "News and Updates", we will collect your email address and name.

When you sign up for our "News and Updates from carefully selected GCX LTD partners", we may pass their contact details on to carefully selected partners.

As is true of most websites, but subject to your browser settings, we automatically gather information about your computer, such as your IP address, browser type, referring/exit pages and operating system.

We may also ask you to complete surveys that we use for research purposes, although you do not have to respond to them.

5. Use of information

We use the information we collect to:


  • provide, maintain, protect and improve our services;

  • protect GCX LTD and our users;

  • contact you in the event of queries or for security reasons;

  • carry out our obligations arising from sales and purchases of digital currency and metal;

  • process and deal with any complaints, feedback, or enquiries made by or about you; and/or

  • investigate any suspected breach of the Agreement by you and to monitor your compliance with the terms of the Agreement.


We will ask for your consent before using your personal information for a purpose other than those that are set out in this Privacy Policy and/or the remainder of the Agreement.

When you contact GCX LTD, we may keep a record of your communication in order to assist both us and you in ensuring that you get the best from our services.

6. Information storage

We may process your personal information on a service located outside the country where you live, and such personal information may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"), such as the Switzerland or the United States. Wherever we process or store your personal information, we will, in addition to complying with all applicable laws and regulations in that jurisdiction, comply with this Privacy Policy.

It may also be processed by staff who operate outside the EEA who work for us or for one of our suppliers. By submitting your personal information, you agree to this processing, storing, and transferring of such personal information in accordance with this Privacy Policy and the remaining terms of the Agreement.

Unfortunately and as acknowledged and agreed by you in the Terms, the transmission of information via the Internet is not completely secure and we cannot guarantee the security of your data transmitted to our Website; any transmission is at your own risk, although GCX adopts industry best practices to safeguard your personal information such as encryption.

7. Choice/opt-out

You may choose to stop receiving our "News and Updates” by following the unsubscribe instructions included in the emails, deselect it on the "Your Account Notifications” page in Your Account, or by contacting us here.

8. Information sharing

GCX LTD will treat as confidential all information it holds in relation to a Customer where that information is not in the public domain. Subject to this clause, GCX LTD will not disclose such confidential information to third parties.

We will share your personal information with third parties in the ways that are described in this Privacy Policy. We will not sell, rent, loan, trade or lease any of your personal information collected, including application forms, financial data, or email addresses. GCX LTD may ask for your permission by email to disclose your personal information to service providers not affiliated with GCX LTD, but you have the right to refuse.

We may provide your personal information to companies that provide services to help us with our business activities. These companies are authorised to use your personal information only as necessary to provide these services to us.

We may share aggregated, non-personally identifiable information publicly and with our partners – like publishers, advertisers, or connected sites. For example, we may share information publicly to show trends, traffic volumes, or publish market research.

We may disclose your personal information to the police, regulatory bodies, or legal advisers, in connection with any alleged criminal offence or suspected breach of the Agreement otherwise relating to you or otherwise where required by law and regulations and we will co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity of or locate anyone breaching the Agreement or otherwise for the prevention or detection of crime or the apprehension or prosecution of offenders.

We recognise your right to confidentiality and privacy and agree that, except when required to provide information to comply with any regulatory or legal obligations imposed upon us or any form of legal process, access to information about you is only provided to our staff and agents and associated service providers (wherever located) who reasonably need to receive that information to allow, facilitate or improve the services provided to you under the customer agreement and only ever on a need to know basis.

We may disclose your personal information to any member of our Group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006.

If GCX LTD or substantially all of its assets or business will be acquired by a third party, personal information held by it about its customers will be transferred assets.

Cookies and other tracking technologies

9. Log files

As is true of most websites, but subject to your browser settings, we gather certain information automatically and store it in log files. This includes such information as internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp and clickstream data.

We use this information, which does not identify individual users, to analyse trends, administer the Website, track users' movements around the Website and gather demographic information about our user base as a whole.

We do not link this automatically collected data to personally identifiable information.

We use a third-party tracking service that uses cookies to track aggregate non-personally identifiable information about visitors to our Website such as number of visits, searched pages and browser type to improve our Website and customer experience.

10. Cookies

When you register to use the Website, we store "cookies", which are strings of code in a small text file, on your computer for record-keeping purposes. We do not link the information we store in cookies to any personally identifiable information you submit while on our Website.

We use HTML5 session cookies for security reasons. These are better protected from theft due to the browsers same origin policy. They also invalidate should you browse to another page, or close your browser requiring you to log back in. If you reject cookies, you may still use our Website, but your ability to use some areas of our Website will be limited.

11. Google AdWords Remarketing

GCX LTD uses, through its Website, the Google Adwords Remarketing service to advertise on third party websites (including Google) to previous visitors to our Website. Google AdWords Remarketing is a remarketing and behavioural targeting service provided by Google. It connects activity on www.gcx.io with the Adwords advertising network.

Google AdWords Remarketing displays relevant advertisements to you based on pages of the GCX LTD Website that you have viewed by placing a cookie on your computer. This cookie does not identify you or give us access to your computer. The cookie allows us to show you relevant advertisements across the Google Advertising Network based on your previous browsing of the GCX LTD website.

Any data that we collect will be used in accordance with this Privacy Policy and Google's privacy policy.

You can opt out of Google Adwords Remarketing by visiting http://www.google.com/settings/ads.

You can opt out of all third party cookie advertising by visiting http://www.networkadvertising.org/choices/.

Security

The security of your personal information is important to us.

When you enter sensitive information such as log-in credentials we encrypt the transmission of that information using Secure Socket Layer (SSL) technology.

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.

We restrict access to your personal information that we hold to GCX LTD employees, contractors and agents who need to know that information in order to process it for us, and who are subject to strict contractual confidentiality obligations at least equal to those we owe to you and such persons may be disciplined or terminated if they fail to meet these obligations.

For security reasons, we do not recommend saving your Account log-in details and Password in your computer's memory (do not allow your browser to remember your Password). Consequently, we advise entering your Account log-in details and Password each time you begin a new browser session and wish to view your Account.

Additional policy information

12. Data retention

We will retain your information for as long as your Account is active or as is needed to provide you services. If you wish to deactivate your Account or request that we no longer use your personal information to provide you services, please contact us. Notwithstanding the above, we will retain and use your information as necessary to comply with our legal obligations and clause 5 above.

13. Links to other websites

Our Website may include links to other websites whose privacy practices may differ from those of GCX LTD. If you submit personal information to any of those sites, your information is governed by their privacy statements. We encourage you to carefully read the privacy statement of any website you visit.

14. Access to personally identifiable information

If your personally identifiable information changes, you may correct, update or amend it through your account or by contacting our GCX LTD Customer Care team.

The Data Protection Act 1998 ("DPA") gives you the right to access personal data we hold about you. Your right of access can be exercised in accordance with the DPA. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.

We will endeavour to respond to your request generally within one business day.
